PART I — PRIVACY POLICY

1. Scope

This Privacy Policy explains how Toss Derby handles information when you use the App and its online features.

2. Information We May Process

Toss Derby may use online services to provide gameplay, player profiles, matchmaking, leaderboards, purchases, and related functionality.

Depending on the features used, we may process limited information such as:

device and operating system information
app version information
crash and diagnostic information
technical and performance logs
anonymous or platform-generated player identifiers
nickname selected by the player
selected in-game avatar
game progress and score information
leaderboard scores and rankings
multiplayer session, lobby, and connectivity information
virtual ticket balances and purchase-related entitlement information

We do not require players to provide their real name, postal address, or phone number for normal gameplay.

3. Player Accounts and Authentication

Toss Derby may use anonymous authentication or supported platform sign-in services to identify players and provide online features.

These services may generate a unique player identifier used for features such as:

multiplayer matchmaking
leaderboard participation
player progress
account linking
restoration of eligible game data

A player's in-game nickname does not need to be their real name.

4. Multiplayer Services

Toss Derby may use online multiplayer services for matchmaking, lobbies, relay connections, and synchronization between players.

Technical information necessary to establish and maintain multiplayer sessions may be processed by the relevant service providers.

5. Leaderboards

If leaderboard functionality is enabled, your selected nickname, score, ranking, and related player identifier may be processed and displayed to other players.

Do not use personal, offensive, unlawful, or inappropriate information as your nickname.

6. How We Use Information

We may use information to:

operate and maintain the App
provide multiplayer gameplay
maintain player progress
provide leaderboards
process or restore eligible purchases
diagnose crashes, bugs, and technical problems
improve performance, stability, and gameplay
prevent cheating, abuse, fraud, or misuse
enforce these Terms and protect the integrity of the App

7. Advertising

Toss Derby is currently designed without third-party advertising.

If advertising is introduced in a future version, this Privacy Policy will be updated where required.

8. In-App Purchases

Toss Derby may offer optional in-app purchases, including virtual ticket packages.

Payments are processed by the relevant platform provider, such as Google Play. We do not directly receive or store your full payment card information.

We may receive limited purchase information necessary to confirm purchases and provide purchased content.

9. Data Sharing

We do not sell personal data.

Limited information may be shared or processed:

by service providers necessary to operate multiplayer, authentication, leaderboards, analytics, purchases, or technical infrastructure
when required by applicable law, regulation, legal process, or valid government request
when reasonably necessary to protect the Company, the App, our users, or the integrity of our services

10. Data Retention

Information is retained only for as long as reasonably necessary for the purposes described in this policy or as required by applicable law.

For example:

technical and crash logs may be retained for troubleshooting
player identifiers and progress information may remain while required to provide online services
leaderboard information may remain while the leaderboard service is active
transaction records may be retained as required by platform providers or applicable law

Where appropriate, information may be deleted or anonymized when it is no longer required.

11. Security

We use reasonable administrative and technical measures to help protect information handled through the App.

However, no online service, storage system, or transmission method can be guaranteed to be completely secure.

12. Children's Privacy

Toss Derby is not directed to children under the age required by applicable law to provide valid consent on their own.

We do not knowingly request personal information from children beyond information reasonably necessary to operate the App.

If you believe information relating to a child has been processed improperly, please contact us.

13. Your Rights

Depending on your location and applicable law, you may have rights relating to information associated with you, including rights to request access, correction, deletion, or further information.

TERMS OF SERVICE

15. Acceptance of Terms

By downloading, installing, accessing, or using Toss Derby, you agree to these Terms.

If you do not agree, do not use the App.

16. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use Toss Derby for personal, non-commercial entertainment purposes, subject to these Terms.

17. Permitted Use

You agree to use the App in accordance with applicable laws and regulations.

You must not:

reverse engineer, decompile, or attempt to extract source code except where permitted by law
interfere with or disrupt the App or its online services
use unauthorized software, exploits, automation, bots, or cheats
manipulate scores, rankings, tickets, purchases, or player progress
attempt to bypass security, monetization, matchmaking, or technical protections
impersonate another player
use inappropriate, unlawful, abusive, or misleading nicknames
interfere with multiplayer sessions or other players
use the App in a way that harms the Company, the App, or other users

18. Player Profiles

Players may be able to select an in-game nickname and avatar.

We may restrict, reset, remove, or require modification of nicknames that are inappropriate, misleading, unlawful, offensive, or otherwise unsuitable.

19. Virtual Tickets, Points, Items, and Rewards

The App may contain virtual tickets, points, collectible plush rewards, cosmetic content, or other virtual game elements.

These virtual items:

have no real-world cash value
are licensed, not sold
may only be used within the App
may not be transferred or exchanged for real money unless expressly permitted
may be adjusted, balanced, limited, or discontinued where reasonably necessary and permitted by law

20. In-App Purchases

Optional in-app purchases may be available.

Purchases are processed by the applicable platform provider and are also subject to that provider's payment, refund, and account policies.

Purchased content will be provided according to the product description and applicable law.

21. Multiplayer and Matchmaking

Toss Derby may match players with other players and may use computer-controlled participants where necessary to create or complete gameplay sessions.

We do not guarantee:

the availability of a specific number of human players
uninterrupted matchmaking
uninterrupted multiplayer connectivity
that every multiplayer session will be completed successfully

Network conditions, disconnections, platform outages, or service interruptions may affect gameplay.

22. Leaderboards and Scores

Leaderboard rankings and scores may be adjusted, removed, or invalidated when reasonably necessary to address:

cheating
exploits
technical errors
corrupted data
abuse
violations of these Terms

23. Availability and Updates

We may update, modify, balance, suspend, or discontinue parts of the App or its services from time to time.

We do not guarantee that the App or any online service will always be available, uninterrupted, or error-free.

24. Intellectual Property

Toss Derby and its related content, including code, gameplay systems, graphics, audio, characters, interface elements, text, designs, and other assets, are owned by or licensed to the Company and are protected by applicable intellectual property laws.

You may not copy, distribute, modify, publish, sell, or commercially exploit any part of the App without prior written permission.

25. Third-Party Services

The App may rely on third-party platform and infrastructure providers for features such as:

authentication
multiplayer connectivity
leaderboards
purchases
cloud or technical services

Use of those services may also be subject to their own terms and privacy policies.

26. Suspension and Termination

We may restrict, suspend, or terminate access to online features where reasonably necessary if a user:

violates these Terms
cheats or manipulates gameplay
abuses other players or services
attempts to compromise the security or integrity of the App

You may stop using the App at any time by uninstalling it.

27. Disclaimer

The App is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.

We do not guarantee uninterrupted operation, error-free operation, permanent availability of online services, or compatibility with every device or platform version.

28. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the App.

This may include loss of:

game progress
scores
rankings
virtual tickets
virtual rewards
multiplayer access
data
profits

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

29. Changes to These Terms

We may update these Terms from time to time.

Updated Terms become effective when published on this page.
